Terms of Service
Effective November 1, 2024
By engaging the services of New Freedom Health or its subsidiary, BEST For Seniors, (collectively referred to herein as “New Freedom Health”, “we”, “our”, and “us”), you indicate that you understand and agree to the following Terms of Service:
New Freedom Health fees are due and payable at the time service is rendered. All fees are the responsibility of the Patient or designated Responsible Party whose signature appears on our patient registration forms. Our services are not covered by Medicare or Medicaid, and we do not accept assignment of insurance benefits. We charge our full session fee for same-day appointment cancellations.
The New Freedom Health program you are enrolled in will employ non-medical therapeutic methods as described in our promotional and educational literature and explained to you by our representatives. Because individual receptivity to non-medical therapeutic methods varies widely, New Freedom Health does not guarantee that you will derive any benefit, or achieve any specific result, from the therapeutic services we provide.
New Freedom Health therapy should not be used in place of treatment by medical professionals. Our staff members cannot diagnose, treat, prevent or cure any illness or condition. New Freedom Health Therapy is not, and cannot be used as a substitute for treatment by a physician, nurse, physical or occupational therapist, chiropractor, massage therapist, or psychotherapist.
The New Freedom Health therapy program you are enrolled in may include active or passive physical exercise. Engaging in exercise places you at risk of injury which, in extreme circumstances, can be fatal. Your New Freedom Health program may include therapeutic physical touch (Somatic Facilitation Therapy). This type of therapy may not be safe for you if you have certain medical conditions. We strongly recommend that you consult a physician before beginning a New Freedom Health therapy program. Because of factors that are unpredictable, uncontrollable, or that we are not aware of, New Freedom Health cannot assume any responsibility for your safety, health or well-being at any time before, during or after your participation in a therapy session. Participation in this program is entirely at your own risk.
You are responsible for setting your physical, mental, and emotional boundaries during therapy. You are not required to engage in any activity that you are uncomfortable with during a New Freedom Health therapy session. Should you become uncomfortable in any way during a therapy session, you should cease activity immediately and inform your New Freedom Health therapist of your concerns.
We make every effort to ensure that the information we publish and convey verbally is accurate. However, New Freedom Health does not guarantee that this information will be free of printing or factual errors. You should not make decisions about your health based on information you obtain from us. Always consult your doctor in matters pertaining to your health.
You grant permission to New Freedom Health therapists to touch your person with their hands, or otherwise make physical contact with you, to further the objectives of your therapy program and for your safety.
You grant permission to New Freedom Health to photograph and videotape you during therapy sessions. (Does not apply to full-body Somatic Facilitation Therapy.) We use these photos and videos as part of your therapeutic record. We also use them to train members of our staff and for research and development of our programs. We may also use them in informational materials we provide to medical professionals, in which case, we will remove any personally identifying information. We will not use photos or videos of you (your “image”) in consumer-directed advertising. In recognition of the personal benefit you derive from the success of New Freedom Health, you waive copyright to your image and claim to royalties or other remuneration for its use by us as described above.
Two observers of your choosing may be present during your therapy sessions. Observers should not be seated in the immediate area in which therapy is being conducted and are not permitted to actively participate in therapy sessions unless invited to do so by our therapist. We reserve the option of asking an observer to leave the room if his/her presence is distracting you.
We are protective of your privacy. We also protect the integrity of our program by limiting how we share information about it. For these reasons, we do not permit electronic monitoring, recording, or photographing of therapy sessions without our permission.
Any dispute, controversy or claim arising out of New Freedom Health’s provision of services to you shall be settled by binding arbitration and not by a lawsuit or resort to court process, and that arbitration will be conducted in Denton County Texas under the Commercial Arbitration Rules of the American Arbitration Association and applicable Texas law.
We may change these Terms of Service at any time. If you are enrolled in therapy when a change is made, we will notify you by email.

New Freedom Health does not provide medical care. New Freedom Health therapists are not doctors, nurses, physical therapists, massage therapists, chiropractors or psychological counselors and they cannot diagnose, treat, prevent or cure any illness or condition or provide medical advice. New Freedom Health services are intended for recreational purposes only. You should never make decisions about your health based on anything published by New Freedom Health or told to you by members of our staff. See your doctor if you have concerns about your physical or mental health and before making any changes to your medications, level of physical activity, diet or dietary supplements.
